Resolving Disputes With Business Mediation

Taking a case to trial can be risky and costly. While a small percentage of business disputes simply cannot be resolved without trial, the vast majority of business disputes can be resolved effectively with innovative legal thinking and proactive problem solving. We address disputes and try to find common sense solutions that may have been previously missed or overlooked.  Of course, we are always thoroughly prepared for the possibility of trial and have a proven record of results in our litigation practice as well.

If you need to speak with a business and commercial law attorney about a dispute that has resulted in litigation or may result in litigation, contact our law office in Westerville, Ohio at 614-895-5600.

Mediation

One way that disputes may be resolved prior to trial is through mediation. This is possible before litigation if parties can consider the cost of litigation, and evaluate the likely outcome of litigation.

In mediation, an impartial mediator - typically an experienced lawyer - is hired by the parties to listen and provide impartial insights to the parties to assist them in resolving their claims. Where it works well, mediation assists the parties to realize the risks that in the heat of their dispute may be difficult for those parties to assess.  Sometimes the parties' counsel are limited in presenting these risks to their clients and to the opposing party because the parties' legal counsel have the job of presenting their client's strongest case.

We have represented clients throughout Ohio in mediation. We consider mediation an effective and meaningful method of dispute resolution in the right circumstances. When cases can not be resolved at mediation, we also represent our clients at trial with a thorough understanding of case facts and relevant case law.

We can represent your business or any client in a wide range of business mediation and litigation, including:

  • Breach of contract disputes
  • Non-competition, confidentiality and severance disputes
  • Partnership and shareholder disputes
  • Commercial real estate disputes
  • Construction disputes
  • General civil litigation and business law matters
