Mediation

A common way that disputes may be resolved prior to trial is mediation. This is possible before litigation if parties can consider the cost of litigation, and evaluate the likely outcome of litigation. In mediation, an impartial mediator - typically a retired judge or experienced trial lawyer - listens to both parties and provides assistance in revealing the benefit of the resolution of all claims.
