When a person dies in the state of Ohio, unless they have provided an alternative method for distribution of their property, their estate will be distributed under Ohio probate law.

There are eighty eight counties in Ohio, and while Ohio has a modern uniform set of probate rules, each county has its own unique procedures that are also used and followed.  In some cases families can avoid Probate if they have planned to do so, but if they have not planned to avoid Probate Administration then the process of paying last illness expenses, covering debts and obligations of the decedent, paying income and estate taxes, and distributing assets under Ohio law is called probate administration.

Important parts of the probate process include:

  • Admission of the Will and appointment of a Fiduciary (Executor or Administrator)
  • Notification of next of kin and beneficiaries under the Will
  • Notification of creditors of the Decedent
  • Inventory of assets of the Decedent
  • Paying debts and obligations of the Decedent
  • Selling assets that must be sold to administer the estate, if appropriate
  • Receiving Money and Property due to the Decedent before death
  • Paying Administration Expenses of the Estate of the Decedent
  • Preparing an Accounting of all Assets and Expenses received and distributed during the Estate
  • Distributing assets to Beneficiaries
  • Filing and preparing in the proper matter Tax Returns for the Estate and/or the Decedent's final income tax return
